Thomas Friedman in an Op-Ed in the New York Times writes, "We might be able to stimulate our way back to stability, but we can only invent our way back to prosperity. We need everyone at every level to get smarter. I still believe that America, with its unrivaled freedoms, venture capital industry, research universities and openness to new immigrants has the best assets to be taking advantage of this moment — to out-innovate our competition. The magistrate judge overseeing a patent infringement case between Motorola Inc. and BlackBerry maker Research In Motion Ltd. has put Motorola's claims on hold so the U.S. Patent and Trademark Office can examine the dispute.Motorola and RIM sued each other for patent infringement in February 2008 after failing to renegotiate a cross-licensing agreement on certain types of cellular telephone technology. RIM is claiming that Motorola infringed nine patents, while Motorola says its rival infringed 14 patents.

“Every patent lawyer in the country is on edge,” says Hans Sauer, speaking about a case that’s headed to the U.S. Supreme Court. Sauer, a patent counsel for the Biotechnology Industry Organization (BIO) in Washington D.C., says lawyers for technology and drug firms are queasy because they see their world heading into unfamiliar territory.
The IP Business Congress is expected to be the single most important gathering in the IP community this year. Over 300 top executives, including Chief IP Officers from Fortune 500 companies, heads of IP at other major companies, global IP thought leaders and senior policy makers, will gather for two days of top-level discussion and debate at the Four Seasons Hotel in Chicago from the 21st to the 23rd of June.
The request for reexam, No. 90/009,432, was made by an online community called Article One Partners LLC that recruits scientists worldwide to look for evidence patents have been improperly issued. Article One Partners, a for-profit group formed by a group of patent attorneys and financial advisors, offered a $50,000 bounty for anyone who could come up with invalidating prior art.
